Homeowner Association Law Overview
We have considerable expertise in homeowner associations, also known as community associations. Most HOAs are governed by the Colorado Common Interest Ownership Act (“CCIOA”), a statute we know well.
We help developers who are forming homeowner associations, which can include master and sub-associations. We have prepared many sets of HOA documents (articles, declaration, bylaws, and rules and regulations). Our HOA documents are easy to read and understand, and notable for their simple language and clear organization.
We especially enjoy the process of forming an HOA, which requires a deep understanding of common areas, boundaries, easements, plats, maps, declarant rights, development rights, HOA governance, reserve requirements and association operating budgets.
To assist real estate buyers who are purchasing property in an HOA, we can review HOA documents, meeting minutes, reserve studies, budgets, and other HOA due diligence matters.
As experienced HOA counsel, we often help HOA boards with understanding applicable HOA laws, understanding covenants, how to amend and enforce covenants, and member voting. We also help HOAs with special assessments, including bank loans and member loans. Additionally, we assist HOAs with third-party agreements, including property management and construction contracts.
We also represent HOAs in enforcement litigation, including foreclosure of HOA liens.
