Leases

Lease Law Overview

We offer extensive expertise in both residential and commercial leases.

For residential leases, Colorado has numerous statutes, including recent changes in April 2024, aimed at protecting tenants. Residential landlords must ensure their leases comply with these evolving regulations.

While commercial leases face less government oversight, they are often more complex to negotiate and draft. We represent both landlords and tenants in various commercial lease types, including office, retail, industrial, warehouse, and more. Our experience extends to ground leases, where tenants construct building improvements, as well as leases for buildings, pad sites, commercial condominiums, multi-use properties, and shopping centers.

Our proprietary commercial lease form, developed over 40 hours, is designed for ease of use across asset classes. It begins with a clear summary of key terms—parties, premises, term, rent, options, security, guarantees, allowed uses, and maintenance responsibilities. This section functions as both an LOI and a lease digest, saving time and simplifying negotiations.

The second part of the form outlines general provisions in simple, easy-to-read language, detailing each party’s responsibilities.

We offer our commercial lease form free to other attorneys, contributing to the legal community by promoting clarity and efficiency in commercial leasing.

We assist with lease due diligence, estoppel certificate reviews, lease assignments, and landlord consents.

We also provide commercial lease eviction services as part of our real estate litigation practice.
